The organiser of the "Real Partners. Me & My STIHL Tool" campaign (hereinafter: "campaign") on the campaign website www.me-and-my-stihl-tool.com and elsewhere is ANDREAS STIHL AG & Co. KG, Badstr. 115, 71336 Waiblingen, Germany (hereinafter: "STIHL"). The campaign begins on 21 May 2014 and runs through until 31 August 2014. The organiser reserves the right to terminate the campaign prematurely or to extend it, without specifying reasons for doing so and without being required to provide an explanation to participants.
How can I take part?
Participants can upload an image of themselves with a STIHL product at www.me-and-my-stihl-tool.com. The upload form is to be used for this purpose. Participation is free and is not contingent on the purchase of goods or services.
STIHL will publish the submitted images at a later date. Participants will receive an e-mail as soon as their images are posted to the gallery. Submission of images does not imply any right to their posting.
Participants have the opportunity to print out a personal certificate (PDF document) once their images have been uploaded. None of the statements contained in the certificate constitutes a declaration on the condition/quality of products or services by STIHL or third parties.
Who can take part?
Participants must be at least 18 years of age and they must be of legal age according to local laws in the city and state where they participate.
What do I receive for participating?
Each participant has the possibility to download a certificate of participation. Further prizes or advantages for participation do not apply.
What restrictions must be observed when selecting an image?
Only images that show persons using the tools in a proper fashion and wearing the recommended personal protective equipment are eligible for posting. STIHL reserves the right to delete any image that does not meet these criteria or to flag the image with a notice of improper use or inadequate protective clothing. Images may not contain tools from other brands. Images that show children or animals in the immediate vicinity of tools are likewise not permitted. Each participant bears sole responsibility for the content of the images he/she uploads. STIHL is under no obligation to verify the proper application of the tools used in the image or to subsequently notify the participant of potential misuse.
Submissions that feature racist or sexist content, convey a political opinion, threaten others, contain insulting or abusive content, glorify violence, infringe on rights or feature advertising, contain offers for services or other commercial content − as well as images that show an unsafe application or inappropriate or dangerous use of the tool − will not be posted to the gallery.
Rights and licences
Participants grant STIHL the right − not limited by time or geographical location, though subject to revocation at any time − to reproduce, distribute, display and make publicly available any image uploaded as part of the "Real Partners. Me & My STIHL Tool" campaign. Participants further grant STIHL the right to edit any image submitted. These rights are valid for all own business purposes of ANDREAS STIHL AG & Co. KG, including instances beyond the scope of the campaign, though limited to use on social media platforms and the internet. For these purposes, the organiser is permitted to grant sub-licences, for example to agencies. As regards the use of an image on the internet, participants are aware that it is not possible to prevent third parties from copying an image and using it for their own purposes. Requests to revoke these rights should be sent via the contact form on the website of this campaign. The revocation of these rights takes effect only if the request contains the name of the campaign, the name of the participant and a precise description of the image.
The organiser accepts the transfer of these rights.
Participants further permit the organiser the use of their names as part of the campaign.
Participants affirm that they are authorised to transfer the rights described above to STIHL. Participants further affirm that they have secured the necessary consent from the person(s) shown in the images and that no images infringe on the rights of third parties.
Participants agree to hold harmless and indemnify the organiser for any and all claims from third parties who assert that the image(s) infringe on their rights.
