1 Background
1.1 Information on how to enter this STIHL Comes to You Commercial Demo Promotion (Promotion) and prize details form part of these terms and conditions (Conditions).
1.2 The promoter is STIHL Pty Ltd trading as STIHL Australia, of 5 Kingston Park Court, Knoxfield VIC 3180, ABN 76 004 881 145 Telephone: (03) 9215 6666 (Promoter).
1.3 The Promotion is a game of chance, and skill plays no part in determining winners. Each Entry will have an equal chance of winning. Participation in the Promotion is free of charge.
1.4 The Promotion will have one (1) winner (Winner). The Winner will receive one (1) prize as set out in this clause 1.4 (Prize). The Prize will consist of one or more of the STIHL battery and accessory products retailed in Australia by the Promoter and/or its authorised STIHL dealers (Eligible Products), as selected by the Winner in consultation with the Promoter and subject to:
(1) stock and availability of the selected Eligible Products; and
(2) the Winner’s selected Eligible Products not exceeding a total and maximum combined value of AUD$10,000 including GST, where the value of a selected Eligible Product is deemed to be equivalent to the GST inclusive recommended retail price (RRP) of that Eligible Product, as specified by the Promoter.
1.5 Entries must comply with these Conditions to be valid.
1.6 By submitting an Entry and otherwise participating in the Promotion, Entrants acknowledge that they have read and understood these Conditions, and they agree to be bound by these Conditions.
2 Promotion Period
2.1 The Promotion commences:
(1) for all of Australia except the Australian Capital Territory—on Thursday, 1 October 2026 at 12:00am AEST; and
(2) for the Australian Capital Territory—on Friday, 9 October 2026 at 12:00am AEDT,
and closes on Tuesday, 15 December 2026 at 11:59pm AEDT (Promotion Period). Entries received outside the Promotion Period will not be valid.
2.2 The draw process, including any further redraws, will occur after the end of the Promotion Period, as set out in clause 5.
3 Eligibility
3.1 Subject to clause 3.2, entry in this Promotion is open to any business that is registered and trading in Australia with a current and valid Australian Business Number (ABN) at the time of entry into the Promotion (Entrant). An Entry into the Promotion may be submitted for the Entrant by an individual aged 18 years or older who is authorised to act for and on behalf of the Entrant (Authorised Representative). Each Entrant may only submit one (1) Entry. Additional or duplicate Entries submitted for an Entrant will be invalid and disregarded by the Promoter.
3.2 Directors, officers, employees, agents and contractors of the Promoter, authorised STIHL dealers and other agencies or companies associated with the Promotion (including employees of retailers participating in the Promotion) and their immediate families are not permitted to submit an Entry in this Promotion on behalf of any business which they directly or indirectly own or control, or in which they have a direct or indirect legal or beneficial interest (Excluded Business). Each Excluded Business is ineligible to participate in this Promotion and cannot be an Entrant hereunder. Any Entries submitted in respect of an Excluded Business are invalid and will be disregarded by the Promoter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3.3 For the avoidance of doubt, authorised STIHL dealers and their directors, officers, employees, agents, contractors and immediate families are not permitted to submit an Entry in this Promotion on behalf of any business which they directly or indirectly own or control, or in which they have a direct or indirect legal or beneficial interest.
3.4 The Promoter reserves the right to verify the eligibility of any Entrant and their compliance with these Conditions at any time. The Promoter may require such information as it considers reasonably necessary for this purpose, including (but not limited to) evidence of the Entrant’s business registration and current ABN, and evidence of the Authorised Representative’s age and their authority to submit the Entry on the Entrant’s behalf.
4 Entry into the Promotion
4.1 To enter the Promotion, an Authorised Representative for the Entrant must complete and submit the Entry form (which is accessible online via this link or by scanning the QR code displayed on promotional material for this Promotion) during the Promotion Period, upon which:
(1) one (1) entry into the Promotion (Entry) will be registered for the Entrant; and
(2) the Entrant’s request for a STIHL commercial product demonstration will be submitted to the Promoter.
4.2 For the avoidance of doubt, an Entrant is not required to participate in or complete the STIHL commercial product demonstration for the Entry to be valid.
4.3 Only one (1) Entry per Entrant is permitted and will be valid. Additional Entries submitted by the same Entrant will be deemed invalid.
4.4 The Promoter may, in its absolute discretion, deem any Entry invalid and disqualify the Entrant if the Promoter reasonably believes that:
(1) the Entrant has not complied with any of the eligibility requirements set out in clause 3.1, or has otherwise attempted to circumvent those requirements or any other requirements set out in these Conditions, including (but not limited to) by using alternate individual or business identities or submitting an Entry without proper authority;
(2) the Entry is illegitimate, forged, AI-generated, duplicated, manipulated or has been tampered with in any way;
(3) the Entry contains false, misleading, incomplete or inaccurate information, or was submitted for, or on behalf of, a business other than the business whose details were provided with the Entry; or
(4) the Entrant has engaged in any conduct that the Promoter considers, in its sole discretion, to be fraudulent, misleading, deceptive, bad faith, or otherwise designed or intended to interfere with the fair and proper conduct of the Promotion.
4.5 Incomplete, indecipherable, or illegible Entries, or Entries that do not comply with these Conditions, will be deemed invalid.
4.6 Entrants are responsible for any costs associated with submitting an Entry, including (but not limited to) any internet, data and telecommunications charges.
4.7 The Promoter accepts no responsibility for any misdirected or lost Entries or Entries not received within the Promotion Period specified in clause 2.1.
5 Winner Selection, Notification and Verification
5.1 The draw to determine the Winner will take place at 5 Kingston Park Court, Knoxfield VIC 3180 on Monday, 18 January 2027 at 12:00pm AEDT (Draw).
5.2 The Draw will be conducted by random electronic draw from all valid and eligible Entries received during the Promotion Period. The first valid Entry drawn will be the Winner. Each Entry drawn will be validated by the Promoter for compliance with these Conditions. Entries that do not comply with these Conditions in any respect will be invalidated and redrawn.
5.3 The results of the Promotion will be published by the Promoter as follows:
(1) the Winner’s business name, State or Territory, postcode and Prize will be published on www.stihl.com.au within approximately 24 hours of the Draw for a period of no less than 28 days; and
(2) the Winner’s business name will be published in a local or national newspaper within 7 days of the Draw, or such other reasonable timeframe as determined by the Promoter.
5.4 All Entrants will be notified by email from the Promoter that the Draw has been conducted and that the Winner has been selected within approximately 24 hours of the Draw. The Winner will also be notified directly by email and telephone using the contact details provided in the Entry within approximately 24 hours of the Draw with details of their prize and with directions on how they may claim their prize (Directions).
5.5 To claim the Prize, the Winner must, within the timeframe specified in the Directions:
(1) verify its eligibility and compliance with these Conditions and, if requested by the Promoter, provide evidence of the authority of the Authorised Representative who submitted the Entry on behalf of the Entrant;
(2) consult with the Promoter to confirm its preferred selection of Eligible Products; and
(3) nominate a participating authorised STIHL dealer for collection of the Prize.
5.6 Subject to the Winner claiming the Prize and completing the requirements in clause 5.5, the Promoter will work with the Winner to confirm the final Eligible Product selection constituting the Prize and the nominated participating STIHL dealer from which the Prize may be collected. The Promoter will arrange fulfilment of the Prize in accordance with clause 7 within 28 days of the Winner being confirmed, subject to any processing or delivery delays which will be notified to the Winner.
5.7 If the Winner cannot be contacted, does not complete the requirements in clause 5.5, or does not claim the Prize within 30 days of the Draw, despite reasonable efforts by the Promoter, is not eligible for the Prize or has not complied with the Conditions, then the Promoter may withdraw the Prize from the Winner and award the Prize to a replacement winner selected by a further draw from all valid and eligible Entries received by the Promoter during the Promotion Period (Redraw).
5.8 To the extent that a Redraw is required under clause 5.7, the Redraw will take place at 5 Kingston Park Court, Knoxfield VIC 3180 on Monday, 22 February 2027 at 12:00pm AEDT. The Redraw will be conducted using the same method as the Draw. The results of the Redraw will be published, and the winner notified, in the same manner as the Draw.
5.9 The Promoter reserves the right to at any time verify the eligibility of any Entrants, the validity of any and all Entries, and the compliance of any Entrant with these Conditions. The Promoter may require such information as it considers reasonably necessary for this purpose and reserves the right to disqualify any Entrant if it reasonably suspects the Entrant has:
(1) provided false or misleading registration information;
(2) tampered with the entry process; or
(3) engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.
6 Prize Details
6.1 The prize for the Promotion is as set out in clause 1.4.
6.2 The eligibility of an Entrant to receive the Prize in the Promotion is conditional on the Entry requirements in clause 4 being satisfied.
6.3 The Winner may select one or more Eligible Products for their Prize, up to a total maximum value of AUD$10,000. All Eligible Product selections are subject to availability of the Eligible Product and the Promoter’s final approval.
6.4 If any selected Eligible Product becomes unavailable for any reason, the Promoter may substitute that Eligible Product with an alternative Eligible Product from the Eligible Product List of comparable specification or value, provided that the total value of the Prize does not exceed the maximum prize value of $10,000 AUD, to the extent permitted by applicable law.
6.5 Any unused balance of the Prize will be forfeited and will not be redeemable for cash, credit or any other benefit.
6.6 The Prize is not transferrable or exchangeable and cannot be taken as (or exchanged for) cash. The availability of Eligible Products may vary and is subject to stock.
6.7 The Prize must be taken as described and no compensation or other amounts will be payable if the Winner is unable to use the Prize. Any costs incurred in connection with taking or using the Prize (including any tax liabilities) will be the sole responsibility of the Winner.
7 Prize selection, delivery and collection
7.1 Following completion of the verification requirements in clause 5, the Promoter will work with the Winner to:
(1) confirm the Winner's final selection of Eligible Products from the Eligible Product List; and
(2) confirm the participating authorised STIHL dealer nominated by the Winner for collection of the Prize.
7.2 The Promoter will arrange for the Prize to be delivered to the participating authorised STIHL dealer nominated by the Winner.
7.3 The Winner must, at their own cost and expense, collect the Prize from the nominated participating authorised STIHL dealer within 30 days of being notified that the Prize is available for collection.
7.4 Title and risk in the Eligible Products forming part of the Prize passes to the Winner upon their collection by the Winner from the nominated participating STIHL dealer.
7.5 Any product handover, safety instruction, registration or warranty documentation required by the Promoter or the STIHL dealer must be completed at the time of collection.
8 Acknowledgements
8.1 By entering into this Promotion, Entrants acknowledge and agree to:
(1) these Conditions; and
(2) the Promoter’s privacy policy (https://www.stihl.com.au/en/legal-info/privacy-policy).
8.2 To the maximum extent permitted by law, the Promoter is not responsible for any loss, damage or injury to Entrants resulting from their entering into or participating in this Promotion.
8.3 Any questions, comments or complaints regarding the Promotion should be directed to the Promoter.
9 Privacy and Consent
9.1 Personal information submitted by the authorised representative may be collected and used for the purpose of conducting this Promotion. The Promoter may also disclose this information to third parties, including participating STIHL Dealers, local regulatory authorities and the Promoter’s agents or third-party service providers, for the purpose of conducting the Promotion, or for promotional and marketing purposes (including for direct marketing), whether during or after the Promotion (Purpose).
9.2 By entering this Promotion, the Entrant consents to the use of the personal information submitted for the Purpose, and also that the Promoter may contact them for future promotional and marketing purposes without payment. Entrants agree that the Promoter may use this information for that Purpose.
9.3 The Promoter agrees that the information collected from Entrants will only be used for the purposes stated in these Conditions.
10 General Terms
10.1 To the maximum extent permitted by law, the Promoter reserves the right to vary the Conditions of, or cancel, the Promotion at any time without liability to any Entrant or other person (subject to compliance with applicable regulations and any directions of a licensing authority).
10.2 The Promoter shall not be liable and excludes all liability (including but not limited to negligence, infringement of third party intellectual property rights and misleading or deceptive conduct) for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for damage to property, personal injury or death suffered or sustained in connection with the Promotion or the use or taking of the Prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter, which otherwise cannot be excluded by law.
10.3 All taxes (excluding goods and services tax), which may be payable as a consequence of the Winner receiving the Prize, are the sole responsibility of the Winner.
10.4 These Conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010 (Cth)), where to do so would contravene that statute.
10.5 In the event of a dispute concerning the conduct of the Promotion or claiming the Prize, Entrants must contact the Promoter to attempt to resolve the dispute in good faith. Any disputes will be addressed by the Promoter with the Entrant. If the dispute cannot be resolved, the Promoter’s decision will be final. The Promoter must act reasonably and in accordance with these Conditions.
10.6 These Conditions are governed by the laws of the State of Victoria. The Parties submit to the non-exclusive jurisdiction of the courts of Australia.
